
Energy AI Hit 70% Autonomy Before Anyone Wrote the Rules
The energy sector operates at 70% autonomy with a third of operations fully autonomous, but the EU AI Act classifies most grid AI as high-risk with compliance required by August 2, 2026 — and most companies cannot inventory the AI systems already running their infrastructure.

Schneider Electric surveyed hundreds of energy and chemicals executives across twelve countries and published the results on March 27. The finding that mattered: the industry is running at 70% autonomy, with a significant share of operations already fully autonomous. The companies plan to push higher by 2030, approaching what Schneider's five-point Autonomous Operations Maturity Model classifies as "high autonomy."
That would be straightforward progress if the regulatory environment had kept pace. It did not. The EU AI Act's high-risk provisions take effect August 2, 2026. Grid management AI, load forecasting systems, fault detection and isolation algorithms — all classified as high-risk under Annex III, Section 2. Companies with European operations have roughly four months to demonstrate compliance or face penalties reaching EUR 15 million or a percentage of global annual turnover, whichever is higher.
The industry automated faster than anyone wrote the rules. Now the rules are arriving, and most companies cannot produce an inventory of the AI systems already running their infrastructure.
The Autonomy Numbers Are Real
The Schneider report, conducted with research partners Censuswide and Development Economics, distinguishes between two metrics that are easy to conflate. The 70% figure describes the average operational autonomy level across surveyed organizations — how much of day-to-day work is handled without direct human control. The separate full automation target for 2030 describes the share of operations that will be completely autonomous, with no human in the loop at all. The Autonomous Operations Maturity Model that frames these findings defines five levels, from fully manual operations through complete autonomy. Most energy companies currently sit in the middle of that progression, past the point where automation assists human decisions and approaching the point where it replaces them.
The executives surveyed were clear about what is driving this. AI was identified as the single biggest enabler of autonomy gains — above cybersecurity, cloud and edge computing, digital twins, and advanced process control. The deployments are already concrete and operational, not pilot-stage experiments. Shell's Scotford Refinery in Canada has moved to open, software-defined automation, replacing proprietary control systems with a modular architecture that can integrate AI-driven optimization. European Energy's Kassoe facility in Denmark operates a commercially viable AI-supported e-methanol plant with remote monitoring capabilities — a power-to-X installation that pairs renewable energy AI with chemical process automation.
Regional variation matters for understanding where compliance pressure will land hardest. GCC countries and Asia lead in current maturity. North America shows the fastest projected acceleration over the next five years. Europe trails in adoption pace — which is notable given that Europe is about to enforce the strictest rules on the AI systems its own energy sector has been slowest to deploy.
What the EU AI Act Requires of Energy AI
The compliance obligation is specific and maps directly onto the systems energy companies are already running. Under Annex III, Section 2, AI systems functioning as safety components in critical infrastructure management — electricity, gas, heating, essential energy services — are automatically classified as high-risk. A single system may trigger classifications under both Annex III and Annex I simultaneously, each carrying separate compliance obligations.
Baker Botts mapped the classifications across the full energy value chain in a March 2026 analysis. The scope is broad. Upstream: automated well control, pressure monitoring, blowout prevention systems. Midstream: SCADA-integrated pipeline monitoring, automated leak detection. Downstream: refinery process control, hazard detection at terminals. Power and utilities: generation control, AI grid management, energy forecasting AI, fault detection and restoration. Nearly every operational AI system in a modern energy company touches at least one of these categories.
Providers must establish quality management systems, documented lifecycle risk management, and design-level human oversight enabling monitoring, intervention, and override. They need comprehensive technical documentation, conformity assessments, and registration in the EU's AI database before deployment. The penalties for non-compliance are calibrated to get attention: fines can reach EUR 15 million or a percentage of global turnover, and the classification process leaves little room for arguing that a grid-connected AI system is not safety-critical.
The core difficulty is the inventory. Many energy companies cannot list all AI systems currently running in their operations, much less classify each one against Annex III categories. They automated incrementally — a forecasting model here, a fault detection algorithm there — without building a centralized registry of what runs, where it connects, and what decisions it makes autonomously.

Three Hundred Bills and No Coordination
Europe is not the only jurisdiction rewriting the rules for energy AI. In the first six weeks of 2026, more than 300 data center bills were filed across thirty-plus US states. The legislative activity is uncoordinated and often contradictory — a state-by-state regulatory maze with no coordinating federal framework.
New York proposed a three-year moratorium on data center construction while officials develop utility impact rules. Oklahoma filed for a moratorium on large-scale facilities through November 2029. At the same time, Senator Tom Cotton introduced the DATA Act of 2026, which would exempt fully off-grid data centers from FERC and Department of Energy oversight entirely by creating a new category of "consumer-regulated electric utilities." Under the bill, data center developers could build their own power systems, physically isolated from the grid — an approach that contrasts with flexible compute models designed to work with grid operators, free of federal rate and reliability regulation. As Mike Jacobs of the Union of Concerned Scientists noted, the threat to utilities' revenue from such an arrangement is obvious.
Several states enacted legislation requiring large electricity users to pay infrastructure costs. Virginia and Georgia are reconsidering data center tax incentives that once attracted billions in investment. Arizona proposed preventing cost-shifts of grid connection expenses onto residential customers. Washington moved to bar data centers from emissions credits under its cap-and-invest program.
Energy companies need AI to modernize the grid and manage rising demand. AI's own energy consumption is what legislators are now targeting. Utility automation advances while the regulatory ground shifts beneath it — and in opposite directions depending on which statehouse you are watching.
Automated Operations, Unbuilt Oversight
Kyndryl's readiness research puts a different frame on the same industry. While the energy sector operates at 70% autonomy, the vast majority of utility leaders report feeling unprepared for external business risks — a readiness deficit significantly higher than in other sectors. Adaptability ranks low as a stated cultural value among utility leadership, well below the cross-industry average.
Most executives expect AI-driven workforce transformation to arrive soon. Yet many frontline workers are underusing AI tools already deployed in their organizations. Return on investment from AI projects has been positive for only a portion of utilities — a figure consistent with broader patterns across agentic deployments where the technology delivers where it is well-integrated but stalls where organizational support lags.
The IFS field service benchmarks show what proper deployment looks like in practice. Utilities using AI-powered planning and scheduling optimization saw substantial gains in technician productivity and sharp reductions in travel time and distance. The difference between those results and the industry average comes down to organizational readiness, not the technology itself.
Companies have automated operations without building the organizational capacity to manage, audit, or comply with the regulations governing those automated systems — a pattern visible across multiple industries where governance trails investment. Running energy AI at scale while being unable to demonstrate what it did, how decisions were made, and whether a human could intervene — that is the exposure regulators have identified. The EU AI Act explicitly requires human oversight mechanisms for high-risk systems. For US companies, more than three hundred state-level bills make clear that similar compliance demands are approaching domestically — piecemeal, on different timelines, and with conflicting goals. Those treating compliance as a problem for the end of the decade will find the rules arrived while they were still drawing up the plan.
